RICHMOND, Va. (AP) — A federal appeals court rejected a bid Monday from former coal executive Don Blankenship, who argued that Donald Trump Jr. defamed him by calling him a “felon.”The 4th U.S. Circuit Court of Appeals in Richmond, Virginia, left in place a lower court's ruling in West Virginia against Blankenship, the former CEO of Massey Energy. He served a year in prison on a misdemeanor charge after he was found guilty of conspiring to violate safety standards at a West Virginia mine before an explosion in 2010 that killed 29 men. Blankenship sued the son of then-President Donald Trump after Donald Trump Jr. posted the comment in May 2018 on social media. The high court also previously turned away Blankenship’s appeal of his misdemeanor conviction.

Senate Majority Leader Chuck Schumer recently discussed a long-shot idea with Sen. Joe Manchin: Making a late entry into the US Senate race in West Virginia to try to hold on to his seat as an independent. Manchin, who threw cold water on the idea and is still planning on retiring from the Senate, confirmed to CNN that he’s discussed the last-ditch bid with Schumer. “I think that’s a long, long, long-shot scenario,” Manchin said of running as an independent candidate. Blankenship ran as a Republican but lost in the 2018 Senate primary, later switching parties in 2024 to run in the contested Democratic primary to fill Manchin’s seat. “I understand the scenario,” Manchin told CNN.

He served a year in prison on a misdemeanor charge after he was found guilty of conspiring to violate safety standards at a West Virginia mine before an explosion in 2010 that killed 29 men. Justice Clarence Thomas, while agreeing with the court's action Tuesday, repeated his call for the court to overturn its landmark 1964 libel ruling in New York Times v. Sullivan. But a deposition and private messages made public in recent weeks has exposed that even Rupert Murdoch doesn’t treat Fox News like an actual news organization. But at Fox News, that’s not the case. It’s just striking to hear Fox leadership like Ryan talk openly behind the scenes about what the company is at its core. Fox News has accused Dominion of having “cherry picked” statements to unfairly malign the network. But it’s hard to see how, under any circumstances, these instructions to a supposed network news chief would be appropriate.
